America’s intelligence chiefs have warned banks of a major hacking threat to cash machines worldwide in the next few days.

The FBI sent out a confidential alert on Friday to warn that cyber criminals are planning a global ‘cash-out scheme’ using malware to take over ATMs and steal millions of dollars.

Banks were warned that they could fall victim to an ‘unlimited operation’ in which millions of dollars could be withdrawn from cash machines.

Smaller banks with less sophisticated security systems are thought to be most vulnerable to an attack using the ‘jackpotting’ technique, the Daily Telegraph reports.

YouTube to Add “Fact Check” Propaganda Messages to MMR Vaccine Videos in Latest Orwellian Attempt to Override Reality

Aug 13th 2018, 22:07, by NaturalNews Network

www.thedailysheeple.com/wp-content/uploads/2017/12/censoryoutube-300×160.jpg 300w” sizes=”(max-width: 560px) 100vw, 560px” />

Not content to stop at banning videos, YouTube has decided to add “fact checks” and quotes to videos on topics that it feels are controversial, and the MMR vaccine is one of them.

Last month, the video sharing platform started placing a blurb of text beneath certain videos offering viewers a “scientific” explanation. For example, the text placed underneath some videos about climate change is taken from a Wikipedia entry on global warming and reads: ”Multiple lines of scientific evidence shows that the climate system is warming.” They’re also questioning sources, with a series of climate videos posted by the RT news site containing a description from Wikipedia about the publisher that says: ”RT is funded in whole or in part by the Russian government.”

The move comes after YouTube announced this spring that it will place descriptions taken from Encyclopedia Britannica and Wikipedia alongside videos about topics that tend to attract conspiracy theories, such as the Oklahoma City bombing and the moon landing. Although YouTube has not shared a full list of topics that will be given this treatment, some of the topics identified in a post to its administrators include global warming, Dulce Base, the Federal Emergency Management Agency, the Kecksburg UFO incident, the 1980 Camarate air accident, and the MMR vaccine.

The company has not notified the users who originally uploaded the videos in question that they will bear these propaganda messages. It is not clear why YouTube is lumping the MMR vaccine’s proven link to autism in the same category as conspiracy theories, but given their track record, politics almost certainly played a big role.

Mother Nature’s micronutrient secret: Organic Broccoli Sprout Capsules now available, delivering 280mg of high-density nutrition, including the extraordinary “sulforaphane” and “glucosinolate” nutrients found only in cruciferous healing foods. Every lot laboratory tested. See availability here.

The Chief Marketing Officer of PragerU, Craig Strazzeri, said YouTube’s new policy, which has affected some PragerU videos, shows its political bias.

He said: “Despite claiming to be a public forum and a platform open to all, YouTube is clearly a left-wing organization. This is just another mistake in a long line of giant missteps that erodes America’s trust in Big Tech, much like what has already happened with the mainstream news media.”

Others have expressed surprise that these blurbs are showing up on videos that are about science rather than conspiracies. YouTube says that even more videos will receive the labels in the months to come and that it is using an algorithm rather than people to determine which videos will be given the blurbs.

Right now, they are only visible to viewers in the U.S., and they are expected to be rolled out gradually. YouTube will be keeping track of how often viewers click on the blurb, which will link back to the original source.

Angry users flocking to speech-protecting sites

People are growing increasingly fed up with YouTube’s attempts to control the narrative and influence what people believe by silencing views that oppose their own. This month, they came under fire for banning right-wing host Alex Jones’s channel, which was just the latest in a long string of moves against videos on topics like vaccines, climate change, natural health and guns.

If you’re looking for a place to post or watch videos without YouTube insulting your intelligence or controlling what you read and share, the free-speech alternative REAL.video is the place to go. With more than 300 new channels joining the platform each day and 1.5 million minutes of video served each week, it provides a destination for people who value freedom to discuss all manner of topics that are unwelcome elsewhere. Best of all, there is no user tracking, shadow banning, or long ads to sit through. As great and fair alternatives like this gain in popularity, one can only hope that YouTube’s reach will shorten dramatically.

Neocon Bill Kristol Celebrates Social Media Purge

Aug 13th 2018, 21:49, by Contributing Author

www.thedailysheeple.com/wp-content/uploads/2016/08/silenced-free-speech-censorship-whiteout-300×219.jpg 300w” sizes=”(max-width: 560px) 100vw, 560px” />

Imagine my surprise.

Neocons are breaking out the champagne to celebrate the removal of Alex Jones from social media.

Goodbye, Alex, and good riddance. @JVLast⁩ pulls no punches. https://t.co/SksrZtTcya

— Bill Kristol (@BillKristol) August 8, 2018

Jonathan Last, the editor of The Weekly Standard digital edition, after defending the removal of Jones, made an interesting comment:

The conservative view isn’t just that communities have the right to create standards—we have always believed that there is wisdom and virtue in doing so. If we didn’t, then we’d be libertarians.

Poor ill-educated fool. Libertarianism is all about ethical standards—primarily the ethic that one individual (or the state) doesn’t have the right to use physical violence against another individual or a group of individuals.

Neocons don’t subscribe to this. In fact, they believe violence is the preferred tool for dealing with stubborn and recalcitrant foreign leaders and regimes that reject the neoliberal economic order.

The cost for imposing this order—cheered on by Kristol and his co-conspirators—cost a million and a half human lives. Bill and his post-Trotskyite comrades declared this as a victory and urged the same treatment for Iran, Libya (mission accomplished), Syria (500,000 dead), Afghanistan (it is reported Trump is looking for a way out), and much of Africa where murderous Saudi Wahhabi inspired terrorists kill hundreds, including school children.

Imagine the shoe on the other foot. If Bill and his comrades were ejected from social media there would be a loud hue and cry—and, of course, the accusation that social media is run by antisemites.

Back in 2003 as the above mentioned invasion was unfolding journalist Jim Lobe wrote about the neocons and their spiritual leader, Leo Strauss. “Strauss is a popular figure among the neoconservatives. Adherents of his ideas include prominent figures both within and outside the administration. They include ‘Weekly Standard’ editor William Kristol,” Lobe wrote.

He cites Shadia Drury who at the time taught politics at the University of Calgary. According to Drury Strauss believed that “those who are fit to rule are those who realize there is no morality and that there is only one natural right—the right of the superior to rule over the inferior.”

Strauss and the neocons believe religion is a tool used to placate the masses. “Strauss viewed religion as absolutely essential in order to impose moral law on the masses who otherwise would be out of control,” Lobe writes.

Imposing moral law—sort of like the imams in Iran.

Or the Taliban.

“The people are told what they need to know and no more,” says Strauss analyst Robert Locke. Drury writes (Leo Strauss and the American Right, St. Martin’s 1999) that the Straussian neocons believe that without their political deception and lies the nation will fall into “anarchy” and nihilism.

Unlike the widely excoriated libertarians, the neocons have a friend in Thomas Hobbes. He believed human beings could only be restrained by a powerful nationalistic state. “Because mankind is intrinsically wicked, he has to be governed,” Hobbes wrote. “Such governance can only be established, however, when men are united—and they can only be united against other people.”

“Perpetual war, not perpetual peace, is what Straussians believe in,” writes Drury, which naturally leads to an “aggressive, belligerent foreign policy.”

Neocons “really have no use for liberalism and democracy, but they’re conquering the world in the name of liberalism and democracy,” Drury told Lobe.

The Straussian philosophy has no tolerance for guys like Alex Jones. In its universe of funhouse mirrors distorting reality there is no room for serious opposition.

It is quite natural for Bill Kristol and the neocons to celebrate scrubbing Alex Jones and libertarians from social media (although Jones is not a libertarian—his lawyer describes him as a performance artist).

More celebration is likely as the social media giants take orders from the state to memory hole the opposition.

Peter Strzok Tweets Link To $150,000 GoFundMe For “Lost Income And Legal Fees”

Aug 13th 2018, 20:58, by Zero Hedge

www.thedailysheeple.com/wp-content/uploads/2018/08/Peter-Strzok-300×167.jpg 300w” sizes=”(max-width: 560px) 100vw, 560px” />

Just-fired FBI agent Peter Strzok hopped on Twitter Monday with a statement from his lawyer and a link to a GoFundMe account set up by the “Friends Of Special Agent Peter Strzok,” which has already raised just under $30,000 in three hours after more than 700 people donated to the fundraiser. Jennifer Kay, a spokeswoman for Strzok’s attorney, confirmed that the Twitter account was authentic according to the Daily Caller.

Deeply saddened by this decision. It has been an honor to serve my country and work with the fine men and women of the FBI. https://t.co/iET9SbeTrv pic.twitter.com/7VTswzjoxE

— Peter Strzok (@petestrzok) August 13, 2018

The page reads:

For the last year, Pete, his work, and his character have been the target of highly politicized attacks, including frequent slanderous statements from President Trump, who actively—and apparently successfully—pressured FBI officials to fire Pete.

All funds raised on this GoFundMe will be put into a trust dedicated to covering Pete’s hefty – and growing – legal costs and his lost income. The trust is being created and details about its management will be shared here as things progress

Given that Strzok’s wife Melissa Hodgman is an Associate Director in the SEC’s enforcement division (with a $250,000 annual salary to boot), the following disclaimer at the bottom of the GoFundMe page comes as no surprise:

*Please note: Due to federal ethics regulations as applied to the Securities and Exchange Commission (“agency”), any donation whose source cannot be determined or which falls into one of the categories below may be returned. Any aggregate donation of $390 or more will be publicly disclosed. We cannot accept donations from any “prohibited source” as defined by federal ethics rules that apply to the agency…

While Strzok appears to have been on Twitter for at least a month – first “liking” a tweet by actor-turned-activist Jim Carrey comparing Rep. Trey Gowdy (R-SC) to an insect, the former FBI agent.

The tweet reads: “When Trey Gowdy woke up one morning from unsettling dreams, he found himself changed into a vile insect. After crawling into the people’s chamber he was promptly squashed by Agent Strzok of the FBI.”

— Jim Carrey (@JimCarrey) July 14, 2018

Strzok subsequently “liked” pro-Strzok / anti-Trump tweets from John Leguizamo, Rosie O’Donnell, Mark Hamill, Bill Kristol and more.

Still no word on which MSM network will sign Strzok for a recurring role in the next stage of the saga, which we assume to be the next logical step.

The Law As A Weapon

Aug 13th 2018, 19:36, by Paul Craig Roberts

Robert Mueller is supposed to be investigating Russiagate, which has been shown to be a hoax concocted by former CIA director John Brennan, former FBI director James Comey, and current deputy Attorney General Rod Rosenstein. As Russiagate is a hoax, Mueller has not been able to produce a shred of evidence of the alleged Trump/Putin plot to hack Hillary’s emails and influence the last presidential election.

With his investigation unable to produce any evidence of the alleged Russiagate, Mueller concluded that he had to direct attention away from the failed hoax by bringing some sort of case against someone, knowing that the incompetent and corrupt US media and insouciant public would assume that the case had something to do with Russiagate.

Mueller chose Paul Manafort as a target, hoping that faced with fighting false charges, Manafort would make a deal and make up some lies about Trump and Putin in exchange for the case against him being dropped. But Manafort stood his ground, forcing Mueller to go forward with a false case.

Manafort’s career is involved with Republican political campaigns. He is charged with such crimes as paying for NY Yankee baseball tickets with offshore funds not declared to tax authorities and with attempting to get bank loans on the basis of misrepresentation of his financial condition. In the prosecutors’ case, Manafort doesn’t have to have succeeded in getting a loan based on financial misrepresentation, only to be guilty of trying. Two of the people testifying against him have been paid off with dropped charges.

Mueller’s investigation is restricted to Russiagate. In other words, Mueller has no mandate to investigate or bring charges unrelated to Russiagate. In my opinion, Muller gets away with this only because the deputy Attorney General is in on the Russiagate plot against Trump. Mueller and Rosenstein know that they can count on the presstitutes to continue to deceive the public by presenting the Manafort trial as part of Russiagate.

The trial judge has twice criticized the prosecutors, asking them on one occasion if they had any evidence of successful fraud. In other words, the judge can tell the difference between actual fraud and a failed attempt at fraud, a distinction the prosecutors don’t want the jury to consider.

However, prosecutors can frame a judge, just as they are trying to frame the presidents of the United States and Russia. Realizing that, the judge backed off.

What the Manafort trial should tell you is how utterly and totally corrupt the United States is. In my opinion there is nowhere an organization as corrupt as the US Dept of Justice (sic).

That Russiagate continues on its corrupt course should tell you how powerless President Trump is. Trump cannot even influence his own Department of Justice, which is doing its best to destroy him.

This Isn’t a Joke – The Entire West Virginia Supreme Court Might Get Impeached

Aug 13th 2018, 16:13, by The Daily Caller

www.thedailysheeple.com/wp-content/uploads/2017/09/justice-court-laws-300×200.jpg 300w” sizes=”(max-width: 560px) 100vw, 560px” />

Who presides over the impeachment trial of a state Supreme Court justice if the entire state Supreme Court is being impeached?

It’s an absurd constitutional hypothetical West Virginians are left to grapple with, after the West Virginia House of Delegates Judiciary Committee drafted articles of impeachment against four justices on the state’s highest court.

Five justices sit on the state Supreme Court in West Virginia. The state legislature has drafted articles of impeachment against Chief Justice Margaret Workman and Justices Robin Jean Davis, Beth Walker, and Allen Loughry. The court’s fifth justice, Menis Ketchum, retired in late July. Ketchum will plead guilty to two federal corruption charges on Aug. 29.

Loughry was placed on unpaid administrative leave in June after a state commission lodged a 32-count complaint against him, alleging pervasive violations of the state ethics code. He has since been indicted in federal court for fraud, witness tampering, and making false statements to investigators. (RELATED: First Justice Suspended From Scandal-Ridden State Supreme Court)

The remaining three justices — Workman, Davis, and Walker — face impeachment for wasting government resources and failing to effectively administer the state courts. All three spent large sums of taxpayer dollars on lavish improvements to their chambers in the state capital, which cumulatively totaled almost $750,000, and allegedly abused state travel resources. Workman and Davis also allegedly authorized compensation for other state judges in excess of the amounts allowed by West Virginia law.

“There appears to be, based on the evidence before us, an atmosphere that has engulfed the court of cavalier indifference to the expenditure of taxpayer funds, to the protection of taxpayer-paid assets, and an almost incomprehensible arrogance that for some reason they are not a coequal branch but a superior branch of government,” Delegate John Shott said during a judiciary committee hearing on Aug. 7.

West Virginia’s constitution provides that the chief justice shall preside over impeachment trials in the state Senate. As Chief Justice Workman herself, however, is subject to impeachment, she is ineligible to preside, as are the rest of her colleagues.

Workman appointed Cabell County Circuit Judge Paul Farrell to the high court on an interim basis late Friday. Farrell will serve in Loughry’s seat, pending the election of a successor in November. Farrell will also preside over impeachment proceedings in the legislature — though Walker disputes his power to do so.

In a short statement issued late Friday, Walker argued against Farrell’s installation as the presiding officer for impeachment.

“I believe it is improper to designate any justice as acting chief justice for impeachment proceedings in which I or my colleagues may have an interest and that have not yet commenced in the Senate,” she wrote.

Prior to this summer’s abrupt turn of events in West Virginia, Davis was cited in the press for possible ethics violations in unrelated matters. The Daily Caller News Foundation reported in March 2017 that a series of contributions made to her 2012 re-election campaign strongly resemble an illegal straw donation scheme, conducted at the behest of an attorney defending a $92 million civil judgment in the state Supreme Court. (RELATED: New Evidence Of Illegal Donations To West Virginia Judge Emerges)

That attorney, Michael Fuller of the McHugh Fuller Law Group, also purchased the Davis family private jet in December 2011.

Davis issued a ruling in 2014 preserving a large portion of Fuller’s $92 million award.

GOP Gov. Jim Justice will appoint new justices if any of the court’s current members are impeached.

Horrifying UN Report Details Widespread Child Rape by High-Level UN Employees

Aug 13th 2018, 14:20, by The Free Thought Project

A deeply disturbing report has finally been released by the United Nations detailing the rampant sexual exploitation of children by UN employees that is widespread, throughout multiple countries.

While pieces of the report were released previously, the full report, detailing the scope and horrifying nature of the abuse was only just released in July.

As Disobedient Media points out in a scathing report,

The publication of a summary version of the report caused a global furor in 2002, eventually leading to some policy changes. However, these efforts have proven woefully insufficient in light of ongoing scandals, including but not limited to the recent Oxfam debacle, the Zoe’s Ark scandal, allegations of horrific sexual abuse in the Central African Republic by UN forces, and the Laura Silsby incident. All of these cases (and many others) occurred after the partial publication of the UNHCR report, pointing to one unsavory conclusion:

Aid work is not a vehicle of charity, but is, in a very real sense, a cover for atrocity. It is a weapon, a blunt instrument of power that is wielded to exploit the most vulnerable populations in crisis around the world. We can now state that sentiment as fact, not opinion.

The report reads like a nightmare and states in part:

“Agency workers from local and international NGOs as well as UN agencies are among the prime sexual exploiters of refugee children often using the very humanitarian assistance and services intended to benefit refugees as a tool of exploitation. Male national staff were reported to trade humanitarian commodities and services, including medication, oil, bulgur wheat, plastic sheeting, education courses, skills-training, school supplies etc., in exchange for sex with girls under 18. The practice appeared particularly pronounced in locations with significant and established aid programs.”

“There was compelling evidence of a chronic and entrenched pattern of this type of abuse in refugee camps in Guinea and Liberia in particular…The number of allegations documented, however, is a critical indicator of the scale of this problem as altogether 42 agencies and 67 individuals were implicated in this behavior…”

“Security and military forces including international and regional peacekeepers, national forces and police units are another significant category of exploiters. UN peacekeepers in Sierra Leone are alleged to be extensively involved in the sexual exploitation of children with the assessment team recording allegations against UNAMSIL peacekeepers from nine countries. Details of these allegations, which also require verification, have likewise been submitted to UNHCR.”

The sex exploiters are men in the community with the money, power and influence: agency workers, peacekeepers, regional and national armed forces, teachers, police, businessmen, diamond miners, refugee leaders and logging company staff.”

One would think that this 2002 report would have curtailed at least some of the abuse when a portion of it was publicly released at the time. However, that appears not to have happened. As TFTP reported earlier this year, an outright frightening dossier released by a former senior United Nations official revealed that United Nations employees have carried out over 60,000 rapes in just the last decade. What’s more, the dossier estimates that the organization currently employs at least 3,300 pedophiles.

In just ten years, under the guise of rendering aid, the United Nations has literally been raping and pillaging countries across the world. The problem has gotten so out of hand that it prompted the former UN insider, Andrew Macleod, to blow the whistle and hand over the evidence to Britain’s Department for International Development (DFID) Secretary Priti Patel.

According to the exclusive report by the Sun, the dossier reveals that on top of the 3,300 pedophiles working for the organization, thousands more “predatory” sex abusers specifically target aid charity jobs to get close to vulnerable women and children.

According to Macleod, anyone who’s attempted to blow the whistle on the horrifyingly rampant abuse is silence and fired.

Sharing his dossier with The Sun, Prof MacLeod last night warned that the spiralling abuse scandal was on the same scale as the Catholic Church’s.

While the report reveals that there are 3,300 current employees who are active pedophiles on the UN’s payroll, Macleod estimates the real number to be far higher.

“There are tens of thousands of aid workers around the world with paedophile tendencies, but if you wear a UNICEF T-shirt nobody will ask what you’re up to.

“You have the impunity to do whatever you want.

“It is endemic across the aid industry across the world”.

“The system is at fault, and should have stopped this years ago.”

According to the report in the Sun:

Professor MacLeod worked as an aid boss for the UN all over the world, including high profile jobs in the Balkans, Rwanda and Pakistan – where he was chief of operations of the UN’s Emergency Coordination Centre.

He is campaigning for far tougher checks on aid workers in the field as well as the abusers among them to be brought to justice, and wants the UK to lead the fight.

The professor’s grim 60,000 figure is based on UN Secretary General Antonio Guterres’s admission last year that UN peacekeepers and civilian staff abused 311 victims in just one 12 month period over 2016.

The UN also admits that the likely true number of cases reported against its staff is double that, as figures outside of war zones are not centrally collated.

Prof MacLeod also estimates that only one in 10 of all rapes and assaults by UN staff are reported, as even in the UK the reporting rate is just 14 per cent.

Based on evidence from Prof MacLeod, ex-Cabinet minister Priti Patel – who resigned in November last year – this week accused senior officials at DFID of being part of the cover up.

“Child rape crimes are being inadvertently funded in part by United Kingdom tax-payer,” explained Macleod.

“I know there were a lot of discussions at senior levels of the United Nations about ‘something must be done’ but nothing effective came of it, and if you look at the record of whistleblowers, they were fired,” he said.

“We are looking at a problem on the scale of the Catholic Church — if not bigger.”

As the Free Thought Project has been reporting for years, none of these predators are ever held liable, and as this report shows, only the ones who expose it are fired.

In a blow to victims of human trafficking worldwide, a massive child sex ring was exposed in Haiti — involving international ‘peacekeepers’ with the United Nations as well as other high-level officials from around the world — and no one went to jail.

Perhaps it’s time we stop relying on the ones who keep getting caught raping children to stop people from raping children. A novel idea indeed.

Police Brutally Smash Window and Drag Man From Car for Seat Belt Violation (Video)

Aug 13th 2018, 14:01, by RT.com

A viral video showing New Mexico State Police smashing a car window and pulling a man from the vehicle sparked outrage online. Officers have responded by releasing their own video of the incident.

Phillip Page and passenger Angela Fisher-Herrera were pulled over in Taso County in February for not wearing a seatbelt, the Albuquerque Journal reports. Page shared a video of the incident on Facebook last week, which shows an officer breaking his car window and pulling Page from the car.

Police have come out in defense of the officer’s actions, saying Page was refusing to comply for 15 minutes before they broke the window. They say he wouldn’t show his identification and was asked to roll down the window 20 times and was warned his window would be broken if he failed to comply.

“I’m standing by my officers,” NMSP Chief Pete Kassetas said. “At some point after a certain amount of time of noncompliance, something has to happen.”

“We didn’t break the window and drag him out of the car because he didn’t have a seat belt on. He got removed from the vehicle forcefully because he didn’t comply,” he said.

KRQE shared video supplied by the state police which shows 11 minutes of dashcam footage taken at the scene. It contradicts the short clip shared by the couple, in which Page tells the officers they never asked for his licence and registration. The police video shows an officer ask for it numerous times.

The pair were arrested for resisting or obstructing a police officer, concealing identity, and making a false 911 call along with the alleged seat belt violations.

Charges were dropped in March for lack of prosecution, the Santa Fe New Mexico reports. The case was filed in April. Page and Herrera-Fisher didn’t go to court as they said they didn’t receive letters advising them of the new date, and a bench warrant was issued for their arrest. Page moved to Oregon after the incident and told the Journal he and Fisher-Herrera are driving back to New Mexico and hope their case will be dismissed.

Jury Ruled Monsanto Liable In Case Of Man Dying Of Cancer After Using Weedkiller

Aug 13th 2018, 13:05, by Natural Blaze

It is with great relief that we announce the following: Monsanto corporation – now a part of Bayer – lost the trial of the century against a man dying of cancer, his cancer alleged to be caused by Roundup herbicide. The corporation was found by a jury to be responsible for all claims and ordered to pay $250 million dollars in punitive damages to school groundskeeper Dewayne Johnson, who’s life and limb are stricken with deadly lymphoma after years of using Roundup Pro and Ranger Pro.

After weeks of arguments and court deliberations, a San Francisco jury sided with Johnson on Aug 8. As ABC7 reports:

Forty-six-year-old Dewayne Lee Johnson filed the civil suit against the pesticide manufacturer.

Johnson’s attorneys say he was diagnosed with non-Hodgkins Lymphoma after spraying Roundup weed killer for two and a half years.

Monsanto released a statement regarding Friday’s verdict:

“We are sympathetic to Mr. Johnson and his family. Today’s decision does not change the fact that more than 800 scientific studies and reviews – and conclusions by the U.S. Environmental Protection Agency, the U.S. National Institutes of Health and regulatory authorities around the world – support the fact that glyphosate does not cause cancer, and did not cause Mr. Johnson’s cancer. We will appeal this decision and continue to vigorously defend this product, which has a 40-year history of safe use and continues to be a vital, effective, and safe tool for farmers and others.”

The jury had different ideas, however.

They felt that the herbicides did in fact cause his Non-Hodgkin’s Lymphoma and that Monsanto failed to warn him of the risk.

Moreover, the jury found that Monsanto “acted with malice, oppression and fraud.”

This trial is the first of its kind and was allowed to proceed speedily because of Mr. Johnson’s terminal condition.

tweet

Our hearts are with Dewayne Johnson and his family during this time of resolution. We certainly hope that the comparatively small compensation is some kind of token of justice, although it can never make up for his suffering.

We also hope that groundskeepers and horticulturalists everywhere will take heed of this story and realize the risks that they unwittingly take.

The Grand Irony of RussiaGate: The U.S. Becomes More Like the U.S.S.R. Every Day

Aug 10th 2018, 19:27, by Charles Hugh Smith

When the Soviet regime exiled Sakharov in 1980, everybody assumed the USSR was permanent and impregnable to collapse.

There are many ironies in the RussiaGate drama, but none greater than this: The U.S. becomes more like the former U.S.S.R. every day. Longtime correspondent Bart D. sketches out the irony:

I look at the US economy and what I see in actual everyday life is that corrupted capitalism has resulted in the same problems for average citizens as what crony communism did for the citizens of the USSR.

Poor consumer choice. Poor resource allocation. Poor quality consumer products. Poor environmental management/outcomes. Hyper-vigilance and hyper-control of Government over its people. Dodgy Utilities. The difference is that the Soviet Union had a better healthcare system than USA currently has and better housing availability for common people.

How’s the irony! Capitalism and Communism ultimately end up with similar outcomes and for the same reason: Cartel behaviours and cronyism.

Exactly. When the system is rigged to benefit insiders, cartels, cronies and elites at the expense of the many “outsiders,” the status quo must mask this reality with propaganda and Big Lies: that is, keep repeating the lie until people believe it due to its embrace by “experts” and authorities.

Case in point: inflation. The masses consuming the mainstream media apparently accept the Big Lie that inflation (i.e. loss of purchasing power of our money) is 2%, i.e. near zero.

But the reality is quite different: stagnant wages + soaring real-world inflation = lower standards of living, which is precisely what the bottom 80% of American households have been experiencing for the past decade of “growth” and “recovery.”

The citizens of the old Soviet regime had a wry saying: they pretend to pay us and we pretend to work. I propose a variation for the hapless US citizenry:

They pretend inflation is low and we pretend to be prosperous.

The current clampdown on social media and alternative media in America is ripped right from the playbook of the Soviet regime. We must “protect” you from “fake news,” lest you start questioning the official narratives of strong growth, prosperity, low inflation, etc.

Then there’s the case of Julian Assange, in exile for releasing what everyone concedes is factual evidence on par with The Pentagon Papers in the 1970s which blew up the false (but convenient to the elites) narratives of the Vietnam War.

They can’t paint Assange with the “fake news” brush, so they exile him just as the old Soviet regime exiled Andrei Sakharov in 1980, a hero of the Soviet Union and laureate of the Nobel Peace Prize in 1975.

Please note that the Soviet Union collapsed a decade after exiling Sakharov. Ramping up repression and official propaganda, strangling dissent and marginalizing independent skeptics are the desperate, last-ditch tactics of a doomed regime that only serves the interests of insiders and elites.

There are many pathways to collapse, with financial collapse being a favorite of regimes that print/borrow immense sums to buy off their populace and enrich the insiders/elites– for example, Venezuela:

When the Soviet regime exiled Sakharov in 1980, everybody assumed the USSR was permanent and impregnable to collapse. In other words, “it can’t happen here.” But it did happen, and believing “it can’t happen here” did nothing but hasten the collapse.

Berlin/Hamburg/Greven/Gerstetten, 13. August 2018.

Conservative Twitter voices say they are being attacked with malicious ‘abusive speech’ complaints

Aug 12th 2018, 17:23, by Mike Rivero

Several prominent journalists raised alarm at baseless complaints being sent to Twitter over stories on sensitive topics, such as the activities of British spy Christopher Steele, and links between Sen. Dianne Feinstein and China.
Conservative newspaper Washington Examiner’s Byron York was reported for posting an apparently innocuous link to his own August 9 story, which exposed the lobbying work Steele, notorious for his Donald Trump dossier, performed for Russian billionaire Oleg Deripaska.

York said that he was not found guilty of violating the social network’s rules.

Another target has been unflattering stories about Democratic senator Feinstein, another key figure in the drive to prove alleged collusion between Donald Trump and the Kremlin. In a blow to the credibility of the Senate Intelligence Committee member, Feinstein was revealed to have employed a Chinese spy on her staff for two decades. Several conservatives reporters dug deeper on the long-standing friendship between China and Feinstein, only to have their efforts flagged up by online complainers.

Two of those who have publicized the rejected complaints against them have been Weekly Standard’s Mark Hemingway and the Federalist’s Ben Weingarten.

12 Best Free YouTube Alternative Sites For Watching Videos In 2018

Aug 12th 2018, 17:11, by Mike Rivero

YouTube is undoubtedly the internet’s most dominant platform for streaming free videos online. It hosts billions of videos that are viewed and commented upon on a daily basis. With the addition of a large amount of content each day, its vast user base continues to grow actively.

However, with guidelines of the platform getting revised without any prior notices and other complaints in tow, a large fraction of unhappy users are looking for other YouTube alternative websites that can offer them similar content.

In case you are one of them and are looking for different video streaming sites, here’s a list of best alternatives to YouTube in 2018.

Thiessen: Where’s the outrage over Clinton-Russia collusion

Aug 12th 2018, 17:05, by Mike Rivero

But as bad as the Trump Tower meeting was, it took place at the request of the Russians. They were the ones who approached the Trump campaign, not the other way around.

By contrast, the Clinton campaign proactively sought dirt on Trump from Russian government sources.

They did it through cutouts. In April 2016, Clinton campaign lawyer Marc Elias retained opposition research firm Fusion GPS to compile incriminating information on Trump. Fusion GPS in turn hired Christopher Steele, a former British MI6 operative with sources among Russian government officials. The result was the salacious dossier, whose sources included “a senior Russian Foreign Ministry figure” and “a former top level intelligence officer still active in the Kremlin.” Steele’s work was paid for by Clinton’s presidential campaign and the Democratic National Committee. That means a paid agent of the Clinton campaign approached Russian officials for damaging material on Trump.

Clinton claims she did not know about Steele’s work. It doesn’t matter. Imagine if Michael Cohen, or another lawyer paid by the Trump campaign and Republican National Committee, had hired a former British spy with campaign money to collect dirt on Clinton from Russian intelligence and foreign ministry officials. Do you think that everyone in Washington would be saying: “There’s no evidence Trump knew, so no big deal — nothing to see here?” Of course not.

Moreover, Clinton officials have defended Steele’s actions. Brian Fallon, Clinton’s campaign spokesman, has said he “would have volunteered to go to Europe and try to help” Steele and would happily have spread dirt obtained from the Russians. “Opposition research happens on every campaign,” he told The Post. He also said: “I am damn glad [Elias] pursued this on behalf of our campaign and only regret more of this material was not verified in time for the voters to learn it before the election.”
In other words, “I love it.”

PayPal censors journalists who criticize Israel

Aug 12th 2018, 17:02, by Mike Rivero

An operative of Israel’s global censorship campaign has admitted to exaggerating claims of anti-Semitism in order to engineer crackdowns on supporters of Palestinian rights.

In the latest instance, Benjamin Weinthal has apparently succeeded in persuading PayPal to close down the account of the French online publication Agence Media Palestine.

This constitutes censorship as it denies journalists the means to raise money for their work and retaliates against them for ideas they express.

Agence Media Palestine says it is considering legal action.

Weinthal presents his efforts as reportage for The Jerusalem Post on the actions of companies like PayPal, but what he really does is instigate crackdowns by feeding information – by his own admission distorted – about those he is targeting.

FLASHBACK – Media "Distortions"

Aug 12th 2018, 16:26, by Mike Rivero

“Our job is to give people not what they want, but what we decide they ought to have.”
— Richard Salent, Former President CBS News.

“News is what someone wants to suppress. Everything else is advertising”.
former NBC news President Rubin Frank

Asked to give a toast before the prestigious New York Press Club in 1880, John Swinton, the former Chief of Staff at the New York Sun, made this candid confession [it’s worth noting that Swinton was called “The Dean of His Profession” by other newsmen, who admired him greatly]:

” There is no such thing, at this date of the world’s history, as an
independent press. You know it and I know it. There is not one of you
who dares to write your honest opinions, and if you did, you know
beforehand that it would never appear in print. I am paid weekly for
keeping my honest opinions out of the paper I am connected with. Others
of you are paid similar salaries for similar things, and any of you who
would be so foolish as to write honest opinions would be out on the
streets looking for another job.

If I allowed my honest opinions to appear in one issue of my paper,
before twenty-four hours my occupation would be gone. The business of
the journalist is to destroy the truth; to lie outright; to pervert; to
vilify; to fawn at the feet of Mammon, and to sell the country for his
daily bread. You know it and I know it and what folly is this toasting
an independent press. We are the tools and vassals of the rich men
behind the scenes. We are the jumping jacks, they pull the strings and
we dance. Our talents, our possibilities and our lives are all the
property of other men. We are intellectual prostitutes. “

Scientist Blasts Media’s ‘Misinformation’ About Global Warming and Wildfires

Aug 12th 2018, 16:23, by Mike Rivero

“So there is a lot misinformation going around in the media, some environmental advocacy groups, and some politicians,” Mass wrote in the first of a series of blog posts analyzing the California wildfires.

Censorship of Infowars Exposes Larger Problem of Silicon Valley Bias

Aug 12th 2018, 16:22, by Mike Rivero

Private companies can, of course, censor whomever they like, but the pattern of behavior from Silicon Valley toward speech in general—and continual inability to treat conservative views fairly on their extremely powerful platforms—is rightly concerning to conservatives who use those platforms.

Infowars is hardly a conservative website, but some fear that the social media “deplatforming” of its content will bleed over to other more mainstream outlets—especially right-leaning ones that don’t conform with the overwhelmingly left-wing values of the tech industry.

Given the vague and increasingly expanding use of the term “hate speech,” it’s not unreasonable to think that purging Infowars is the tip of the iceberg.

Now, a little blurb from Wikipedia or Encyclopedia Britannica appears under videos that call climate change into question, ensuring that the public knows, “Multiple lines of scientific evidence show that the climate system is warming.”

Merkel Party Member Tells Germans Not to Be Worried About Becoming a Minority

Aug 12th 2018, 16:14, by Mike Rivero

A member of German Chancellor Angela Merkel’s Christian Democratic Union (CDU) has penned a column telling Germans they should not be worried about becoming minorities in their cities.

CDU politician Barbara John has claimed “it is only a matter of time before people with a migration background make up the majority of the population in larger cities,” and that Germans should not be worried, in a column the 80-year-old penned for German paper Tagesspiegel this week.

Last year, Frankfurt became the first city in Germany in which native Germans are a minority and almost all the recent population growth in the country has been shown to have been driven by mass migration.

Judicial Watch announced today that it filed a Freedom of Information Act (FOIA) lawsuit against the U.S. Department of Homeland Security (DHS), the Department of State, and the U.S. Department of Defense for all records of communications regarding anti-Israel group Boycott, Divestment and Sanctions’ (BDS) efforts to lobby the Obama administration to adopt policies to harm companies doing business with Israel (Judicial Watch v. U.S. Department of Defense (No. 1:18-cv-01721)).

The suit was filed after all three agencies failed to respond to nearly identical April 23, 2018, FOIA requests seeking:

More than 100 newspapers will publish editorials decrying Trump’s anti-press rhetoric

Aug 12th 2018, 16:05, by Mike Rivero

The Boston Globe has been contacting newspaper editorial boards and proposing a “coordinated response” to President Trump’s escalating “enemy of the people” rhetoric.

“We propose to publish an editorial on August 16 on the dangers of the administration’s assault on the press and ask others to commit to publishing their own editorials on the same date,” The Globe said in its pitch to fellow papers.

URGENT APPEAL FROM THE CHILDREN IN GAZA

Aug 12th 2018, 16:03, by Mike Rivero

This is difficult to write. Gaza Children’s Cinema team is mourning the destruction of the Said Al-Mishal Cultural Center which was levelled to the ground yesterday after Israeli fighter jets struck the five-story building with 10 rockets. The second largest cultural centre in Gaza was a venue for theatre and music performance in the besieged and isolated Gaza Strip. This cultural centre was one of the main places where Gaza Children Cinema team organised movie screening for children. The Said Al-Mishal Cultural Center provided spaces of entertainment and joy for generations of children and young people in Gaza; it is in total ruins now.

Left-wing journalists CELEBRATE the complete censorship of Alex Jones, claiming the First Amendment only applies to “official” views

Aug 12th 2018, 15:54, by Mike Rivero

“Gone are the days of leftists hating on corporations and warning of a dystopian future world run by global capitalists and in are the days of leftists cheering a dystopian present where global capitalists shut down all speech they disagree with to crush a middle class revolt,” writes Chris Menahan for InformationLiberation.com.

It just goes to show that the Left is comprised of nothing more than deranged, childish, groupthink drones who are completely consumed with a “me, Me, ME!” mentality. It’s all love and tolerance, just so long as I don’t have to be offended by anyone else’s viewpoints, is basically the liberal narrative of today – hence why we’re now in a position where conservatives are being openly censored and persecuted by liberal tyrants.

North Carolina ferry captain and crew member are suspended for hoisting ‘Trump 2020’ flag on state-owned boat

Aug 12th 2018, 15:46, by Mike Rivero

Officials with North Carolina’s ferry system have suspended a boat captain and crew member for a week after they hoisted a flag supporting President Donald Trump’s re-election on a state-owned ship.

Catherine Mitchell, a passenger on the MV Frisco ferry, took a picture of the ‘Trump 2020’ flag flying below the U.S. flag and even with the North Carolina flag and posted it to Facebook on July 26.

The suspensions given were for ‘unacceptable personal conduct,’ North Carolina Department of Transportation’s Ferry Division spokesman Tim Hass said on Friday to The Charlotte Observer.

"Free, Independent" Boston Paper Urges Collusive National Media ‘War’ Against Trump

Aug 12th 2018, 15:45, by Mike Rivero

“We are not the enemy of the people,” exclaims Marjorie Pritchard, deputy managing editor for the editorial page of The Boston Globe, presumably referring to a characterization of ‘fake news’ journalists that President Trump has used in the past.

Trump’s latest outburst toward the press was at an Aug. 2 political rally in Wilkes-Barre, Pennsylvania, where he told his audience that the media was “fake, fake disgusting news.”

“What ever happened to the free press? What ever happened to honest reporting?” the president asked, pointing to journalists covering the event. “They don’t report it. They only make up stories.”

And that seems to have ‘triggered’ Pritchard.

And in an attempt to fight back against what she calls Trump’s “dirty war against the free press,” AP reports that The Globe has reached out to editorial boards nationwide to write and publish editorials on Aug. 16 denouncing the President’s comments.

Vaccine Corruption Exposed To Washington State Board of Health

Saudi Sovereign Wealth Fund Shows "No Interest" In Tesla LBO

Aug 12th 2018, 15:44, by Mike Rivero

And with Soft Bank gone, only one potential anchor investor remained: the one that started last week’s Tesla surge in the first place, the Saudi Arabian Sovereign Wealth Fund, which as the FT reported less than an hour before Elon Musk tweeted his LBO proposal, had purchased a stake just below 5% in TSLA shares in the open market (but not directly from the company), sparking speculation that it may be interested in acquiring the entire company.

However, as Reuters reports on Saturday, these hopes were also crushed because according to two sources familiar with the matter, “Saudi Arabia’s Public Investment Fund (PIF) has shown no interest so far in financing Tesla CEO Elon Musk’s proposed $72 billion deal to take the U.S. electric car maker private, despite acquiring a minority stake in the company this year.”

The CIA’s Double Standard Revisited

Aug 12th 2018, 15:41, by Mike Rivero

The Central Intelligence Agency has practiced a double standard for many years. Former CIA director David Petraeus escaped a jail sentence despite providing eight notebooks of highly classified information, including names of covert operatives, to his biographer-mistress. Conversely, Reality Winner, a former Air Force linguist, has been in jail for the past year, awaiting sentencing for leaking a classified report about Russian interference in the 2016 elections. Everyone in the United States is talking about Russian interference in the U.S. elections.

There is nothing new here, however. Former CIA director John Deutch placed sensitive operational materials on his home computer, which was used to access pornographic sites, but he was pardoned by President Bill Clinton. Clinton’s national security adviser, Samuel Berger, received a modest fine for stuffing into his pants classified documents from the National Archives. And Attorney General Alberto Gonzales was not even charged when he kept sensitive documents about the NSA’s massive surveillance at his home. Conversely, my good friend Tom Drake was charged with violations under the Espionage Act for “mishandling” what turned out to be unclassified information.

Now we have recent examples of a double standard that is abetted by the media.

Russian Warship Said To Locate And Track US ‘Stealth’ Nuclear Sub For Hours

Aug 12th 2018, 15:39, by Mike Rivero

Russian state-owned RT News translated sections of the exclusive Izvestia story, and describes the claimed April incident as follows:

The frigate Admiral Essen of the Russian Black Sea Fleet managed to track down one of the Ohio-class submarines currently in service with the US Navy, Izvestia newspaper revealed on Friday, citing a source in the Russian Navy. The Russian ship left Sevastopol, a major Black Sea port located on the Crimean Peninsula, on March 13 and returned on June 30. The frigate was deployed most of the time in the Mediterranean Sea.

RT touts the claimed success of the operation, echoing military sources, as follows:

The pursuit lasted more than two hours, during which the Russian ship recorded the basic parameters of the American submarine, which will be deciphered and added to the acoustic characteristics of the submarine…

Even locating a submarine in the sea is a great success, Vladimir Ambartsumyan, who once served as a commander on the naval brigade within the Russian Northern Fleet, told Izvestia. “Nuclear submarines are complex objects for detection,” he told the paper.

The US Department of Defense has yet to respond to the claims, and if it does will likely blast the Russian military-sourced claims as false.

Iran Sanctions Fallout: China Takes Over French Share In Giant Iran Gas Project

Aug 12th 2018, 15:37, by Mike Rivero

When it comes to the Middle East, China has not been shy about its recent ambitions to expand its geopolitical influence in the Gulf region: Just last week we reported that the Chinese Ambassador to Syria, Qi Qianjin, shocked Middle East pundits and observers by indicating the Chinese military may fill the void left in the wake of the collapse of ISIS – and most regional armies – and directly assist the Syrian Army in an upcoming major offensive on jihadist-held Idlib province.

The “[Chinese] military is willing to participate in some way alongside the Syrian army that is fighting the terrorists in Idlib and in any other part of Syria,” the ambassador said in an interview with the pro-government daily newspaper Al-Watan, subsequently translated by The Middle East Media Research Institute (MEMRI).

And having staked a military claim in Syria, China was next set to expand its national interest in that other key regional nation which has been the source of so much consternation to its neighbors and world powers in recent months and which has emerged as a key source of crude oil exports to Beijing: Iran.

Censorship Purge Signals Imminent False Flag Violence Before Mid-Term Elections… Bigger Than 9/11?

Aug 12th 2018, 15:37, by Mike Rivero

The aggressive, unprecedented PURGE of Alex Jones / InfoWars underscores the desperation of the totalitarian deep state that’s about to make a move to eliminate President Trump and / or steal the elections.

Anyone who believes that the sudden de-platforming of Alex Jones across over a dozen online services and platforms isn’t coordinated collusion is delusional. The coordinated de-platforming effort is clearly directed by the deep state to eliminate a prominent, dissenting voice in preparation for unleashing a history-shaping false flag attack that’s likely going to be bigger than 9/11.

The radical Left is escalating its violence across America, and the tech giants are dramatically escalating their censorship actions to silence all independent voices that might question any “official” narrative.

It all points to something big about to come down – something so big that only the official narrative can be allowed to be heard or spoken.

North Korea Praises Trump, Slams Other US Officials for Sabotaging Peace

Aug 12th 2018, 15:35, by Mike Rivero

The North Korean Foreign Ministry accused “high-level officials within the US administration” of “going against the intention of President Trump to advance the DPRK-US relations” in a statement Thursday. Meanwhile, the socialist state renewed calls for a permanent peace treaty so that “a mood will be created for creating trust.”

The press statement, carried by Korea Central News Agency, laid out the position of the government of the Democratic People’s Republic of Korea (DPRK), the official name of North Korea, on the burning question of peace on the Korean Peninsula: US President Donald Trump wants peace, but the agreement reached in Singapore in June is being sabotaged by other US state officials.

“We hoped that these goodwill measures would contribute to breaking down the high barrier of mistrust existing between the DPRK and the US and to establishing mutual trust,” the statement said. “However, the US responded to our expectation by inciting international sanctions and pressure against the DPRK.”

Is Merkel saving face? Controversial Germany-Spain deal on migrants comes into force

Aug 12th 2018, 15:34, by Mike Rivero

As a Berlin-Madrid deal to send back migrants coming though Spain comes into force, critics call it a “symbolic” gesture aimed to calm the political storm in Germany but that will not solve the migrant crisis.

Germany reached a deal on Wednesday for Spain to take back previously registered migrants who show up at the German border. The move is seen as the first step towards implementing a deal which Merkel earlier reached within the ruling coalition to defuse the political dispute in Germany over migration.

Trump blames ‘clowns and losers’ Comey & co for loss of FBI’s ‘stellar reputation’

Aug 12th 2018, 15:33, by Mike Rivero

US President Donald Trump branded ex-FBI executives James Comey and Andrew McCabe as “clowns and losers” in a tweet criticizing them and other officials for ruining the once “stellar reputation” of the FBI.

“Will the FBI ever recover its once stellar reputation?” he asked while calling out Comey and McCabe, along with former FBI agent Peter Strzok and “his lover, the lovely Lisa Page” – a former FBI lawyer.

Trump claimed that they along with other dismissed top officials tarnished the name of the FBI. “So many of the great men and women of the FBI have been hurt by these clowns and losers!”

Trump Takes on the Fed

Aug 12th 2018, 15:32, by Mike Rivero

How could the president take control? Bove explained:

The Board of Governors of the Federal Reserve is required to have seven members. It has three. Two of the current governors were put into their position by President Trump. Two more have been nominated by the president and are awaiting confirmation by the Senate. After these two are put on the Fed’s board, the president will then nominate two more to follow them. In essence, it is possible that six of the seven Board members will be put in place by Trump.

Those seven, along with five federal district bank presidents, compose the Federal Open Market Committee, which sets monetary policy; and one of those district bank presidents, Minnesota Fed head Neel Kashkari, is already arguing against further rate increases. Bove concluded:

YOUTUBE IS CENSORING SF’S NEW 1.5-HOUR LONG VIDEO “RUSSIAN MILITARY CAMPAIGN IN SYRIA 2015-2018”

Aug 12th 2018, 15:24, by Mike Rivero

YouTube is censoring SouthFront’s new 1.5-hour long video “Russian Military Campaign in Syria 2015-2018“.

This video is a detailed summary of military and political developments in Syria since the start of the Russian military operation until now. It was released by SouthFront on August 11.

Less than 2 hours after the release, this video was placed behind an age restriction because it allegedly includes “violent or graphic content that appears to be posted in a shocking, sensational, or disrespectful manner”. The age-restriction clearly impacts a possible reach of the video because it does not allow people without YouTube accounts to watch it.

A church does not have to apply for exempt status, but it is a prudent step particularly for an innovative organization like PCMW. My source indicated that the approval process was reasonably quick and there was no push-back from the IRS. …

Iranian, Kazakh Presidents Discuss Replacing Dollar-Based Trade with National Currencies

Aug 12th 2018, 14:42, by Old_Logan

Iranian President Hassan Rouhani and his Kazakh counterpart Nursultan Nazarbayev in a meeting in Kazakhstan on Sunday conferred on ways to increase economic cooperation, emphasizing the need for both countries to use national currencies for trade instead of dollar.

Tehran and Astana can take more effective steps on the path of development of bilateral relations by establishment of more brokering ties and using their national currencies,” President Rouhani said during the meeting on the sidelines of leaders of Caspian Sea littoral states’ summit in the Kazakh port city of Aqtau on Sunday.

He also underscored the necessity for strengthening banking relations between the two countries to further expand bilateral economic ties.

We believe that “internet access” should include access to all of the internet, without the internet provider discriminating some online services over others. The end-user, not the internet provider, should be able to decide what he or she does on the internet. Soon after the new European rules on net neutrality came into force, T-Mobile started to test the limits of these rules. T-Mobile did this by offering the service “Datafree Music”, among other things.

T-Mobile’s service “Datafree Music” runs counter to the principle of net neutrality. It is a service allowing you to use certain music services over your mobile internet connection without the traffic of these services being counted towards your data plan. . But T-Mobile’s service only works with a small number of music services. That is because T-Mobile gets to decide what a “legal music service” is, and furthermore because they impose all kinds of conditions upon the service providers. If such a provider can’t or won’t comply with this, they will be left out. Even though T-Mobile claims that every service can participate, reality is more unruly: more than a year after the introduction, only a handful of music services have joined.

Bits of Freedom thinks that if you get access to the internet, you should get access to the entire internet. If providers offer one or more services more cheaply than their competitors or innovative alternative options, users will be pushed to use these zero rated services over other services. This yields an unfair advantage, taking away the opportunity for competitors and newcomers to compete for users on their own merit.

If you get access to the internet, you should get access to the entire internet.

Bits of Freedom files an enforcement request

In December 2016 the Dutch national regulatory authority ACM already ruled that this service runs counter to the Dutch explanation of the Regulation on net neutrality (“Regulation”). T-Mobile challenged this decision in court and was vindicated. The judge found the Dutch “extension” to the European rules, including a categorical ban on zero rating, in violation of the Regulation itself.

In May 2017, Bits of Freedom filed an enforcement request, based on the rules of the Regulation itself. The ACM denied this request, a decision we immediately objected to. In February 2018, the ACM decided again that T-Mobile is allowed to continue violating the net neutrality principle enshrined in the Regulation.

Bits of Freedom takes Dutch regulatory authority to court

In March 2018, Bits of Freedom has appealed this decision by the ACM. By appealing the decision, this issue has be brought before an administrative court. In this appeal our primary aim is to convince the judge to ask preliminary questions to the Court of Justice of the EU about the alleged room for zero rating on the basis of categories of applications and services determined by the provider under the Regulation.

In short, Bits of Freedom takes the position that the Regulation does not provide room for zero rating for a category of services (defined by the internet access provider) and only allows for application-agnostic zero rating. Our appeal may potentially have consequences for other Member States, since this is all about the legal interpretation of the Regulation.

Limited room for zero rating under the Regulation

In our appeal, we explain why the interpretation of the ACM (and the BEREC Guidelines) is incorrect, and that the possibilities for zero rating under the Regulation are more limited. According to our interpretation, T-Mobile’s offer is not allowed.

According to the ACM and BEREC it is allowed in principle to not charge network traffic of a general service category (e.g. music streaming services), subject to certain conditions. All propositions in which zero rating is applied, have to be assessed on a case by case basis, according to the ACM and the BEREC Guidelines.

In the specific case of the “Datafree Music” service, the ACM is of the opinion that T-Mobile is not breaking the rules. In short, the ACM considers that T-Mobile treats all music streaming services equally because the same conditions apply for each of them. T-Mobile is therefore said to not discriminate.

However, we argue that the room for zero rating is much more limited under the Regulation than the ACM (and BEREC) supposes. It is not allowed to differentiate between services and to treat internet traffic differently (for commercial reasons) if this happens on the basis of the sender or receiver, the content to which access is requested or which is distributed, the used or provided applications or services, or the terminal equipment (Article 3(1) and 3(3) Regulation).

When following this interpretation, zero rating of internet traffic based on a time of day (e.g. during off-peak hours) and in an application agnostic manner would be allowed, but based on a category of applications or services that are self-determined by the internet provider, it wouldn’t. The Regulation allows only for application-agnostic zero rating.

Under this interpretation, reasonable traffic management measures are still possible, as long as they are non-discriminatory and proportionate, and are not commercially based (see Article 3(3) Regulation). During peak hours, traffic of video streams could still be prioritized over email traffic.

You, and not your internet provider, should get to decide what you do on the internet.

“We are in the process of preparing a listing for public consumption of all of the items contained in the technical logs you received. We are working to get this information to you as soon as possible.”

Aug 6th 2018, 08:11, by Rejo Zenger

Aug 3rd 2018, 19:18, by Hans de Zwart

When it comes to wealth redistribution and the social safety net, they sound like North Sea progressives. When you ask them about unions or regulations, they sound like the Koch brothers.”
